1.0 General
1.1 By entering this website (GMP7) you agree to and acknowledge all terms and conditions stated hereafter. If these Terms and Conditions are not accepted in full, you do not have permission to access the contents of this website and use any or all related services of the GMP Online Consultancy website and therefore should cease using this website immediately.
1.2 If any of these Terms and Conditions should be determined to be illegal, invalid or otherwise unenforceable by reason of the laws of any state or country in which these Terms and Conditions are intended to be effective, then to the extent and within the jurisdiction which that Term or Condition is illegal, invalid or unenforceable, it shall be severed and deleted from this clause and the remaining terms and conditions shall survive, remain in full force and effect and continue to be binding and enforceable.
2.0 Limitation of liability
By entering the GMP7 website you acknowledge and agree that use is at your own risk and that none of the parties involved in creating, producing or delivering this site and its services (consultancy advice) is liable for any direct, incidental, consequential, indirect or punitive damages, or any other losses, including, but not limited to, loss of profits, costs or expenses of any kind (including legal fees, expert fees, or other disbursements) which may arise, directly or indirectly, by using knowledge provided by our consultancy service or through accessing, using or browsing the GMP7 website or through your downloading of any materials, data, text, images, video or audio from this site, including, but not limited to, anything caused by any viruses, bugs, human action or inaction or any computer system, phone line, hardware, software or program malfunctions, or any other errors, failures or delays in computer transmissions or network connections.
3.0 Warranty, variations and changes
3.1 GMP7 reserves the right to revise this legal information at any time and for any reason and reserves the right to make changes at any time, without notice or obligation, to any of the information contained on this site. By entering this site you acknowledge and agree that you shall be bound by any such revisions. You shall be responsible for reviewing such Terms and Conditions regularly before you use this website or make applications or consultancy requests or conduct any kind of transactions.
3.2 Although the information contained on the site is based upon up-to-date information, and while GMP7 makes all reasonable efforts to ensure that all material on this site is correct, accuracy cannot be guaranteed and GMP7 makes no warranties or representations as to its accuracy. This site, and all information and materials contained herein, is provided to you “as is” without warranty of any kind, either express or implied, including, but not limited to, the implied warranty of merchantability, fitness for a particular purpose, title and non-infringement.
4.0 Right of Use
The customer of GMP7 is only permitted to use the documents and templates downloaded from the GMP7 website for the purposes of conducting your business within its own organization or legal entity. A coustomer ist not permitted to reproduce the documents, templates, information or materials on the website for the purposes of sale or the use by any third party. In particular you are not permitted to republish, upload, transmit electronically or otherwise or distribute any of the documents that you download from the GMP7 website outside of your legal entity. You are permitted to download a copy of the documents and retain them on computers used in your business for any legitimate or proper purpose of conducting your business.
5.0 German law
These Terms and Conditions shall be governed by and construed in accordance with the laws of Germany. Disputes arising here from shall be exclusively subject to the jurisdiction of the courts of Germany.
6.0 Right of return / Vereinbarung über Rücksendekosten bei Ausübung des Widerrufsrechts
Wenn Sie von Ihrem Widerrufsrecht Gebrauch machen, haben Sie die regelmäßigen Kosten der Rücksendung zu tragen, wenn die gelieferte Ware der bestellten entspricht und wenn der Preis der zurückzusendenden Sache einen Betrag von 40 Euro nicht übersteigt oder wenn Sie bei einem höheren Preis der Sache zum Zeitpunkt des Widerrufs noch nicht die Gegenleistung oder eine vertraglich vereinbarte Teilzahlung erbracht haben. Anderenfalls ist die Rücksendung für Sie kostenfrei.
Widerrufsbelehrung
1. Widerrufsrecht
Sie können Ihre Vertragserklärung innerhalb von 14 Tagen ohne Angabe von Gründen in Textform (z.B. Brief, Fax, E-Mail) oder – wenn Ihnen die Sache vor Fristablauf überlassen wird – durch Rücksendung der Sache widerrufen. Die Frist beginnt nach Erhalt dieser Belehrung in Textform, jedoch nicht vor Eingang der Ware beim Empfänger (bei der wiederkehrenden Lieferung gleichartiger Waren nicht vor Eingang der ersten Teillieferung) und auch nicht vor Erfüllung unserer Informationspflichten gemäß Artikel 246 § 2 in Verbindung mit § 1 Abs. 1 und 2 EGBGB sowie unserer Pflichten gemäß § 312e Abs. 1 Satz 1 BGB in Verbindung mit Artikel 246 § 3 EGBGB. Zur Wahrung der Widerrufsfrist genügt die rechtzeitige Absendung des Widerrufs oder der Sache. Der Widerruf ist zu richten an:

2. Widerrufsfolgen
Im Falle eines wirksamen Widerrufs sind die beiderseits empfangenen Leistungen zurückzugewähren und ggf. gezogene Nutzungen (z. B. Zinsen) herauszugeben. Können Sie uns die empfangene Leistung sowie Nutzungen (z. B. Gebrauchsvorteile) nicht oder teilweise nicht oder nur in verschlechtertem Zustand zurückgewähren beziehungsweise herausgeben, müssen Sie uns insoweit Wertersatz leisten. Für die Verschlechterung der Sache und für gezogene Nutzungen müssen Sie Wertersatz nur leisten, soweit die Nutzungen oder die Verschlechterung auf einen Umgang mit der Sache zurückzuführen ist, der über die Prüfung der Eigenschaften und der Funktionsweise hinausgeht. Unter "Prüfung der Eigenschaften und der Funktionsweise" versteht man das Testen und Ausprobieren der jeweiligen Ware, wie es etwa im Ladengeschäft möglich und üblich ist. Paketversandfähige Sachen sind auf unsere Gefahr zurückzusenden. Sie haben die regelmäßigen Kosten der Rücksendung zu tragen, wenn die gelieferte Ware der bestellten entspricht und wenn der Preis der zurückzusendenden Sache einen Betrag von 40 Euro nicht übersteigt oder wenn Sie bei einem höheren Preis der Sache zum Zeitpunkt des Widerrufs noch nicht die Gegenleistung oder eine vertraglich vereinbarte Teilzahlung erbracht haben. Anderenfalls ist die Rücksendung für Sie kostenfrei. Nicht paketversandfähige Sachen werden bei Ihnen abgeholt. Die Frist beginnt für Sie mit der Absendung Ihrer Widerrufserklärung oder der Sache, für uns mit deren Empfang.
Ausschluss des Widerrufsrechts
Bei Download-Produkten erlischt das Widerrufsrecht vorzeitig mit Abschluss des Downloads.

7.0 System Integrity
You undertake to us that you will not use and that you will not permit the use of any device, software or programming routine that interferes or attempts to interfere with the working and functionality of our website. You undertake not to take or permit the taking of any action that imposes an unreasonable or disproportionately large load on our infrastructure. You agree that you will not use any robot, spider, other automotive device or manual process to monitor or copy our web pages or the content contained on the GMP7 website without our prior written permission.

8.1 Services offered on the GMP7 web site are available only to persons, companies or other corporate bodies who are capable of forming valid legally binding contracts under their domestic law.
